Terms of Engagement
What is agreed when a request is submitted or a quotation is accepted.
Application of These Terms
Three things fall under these terms: requests submitted through cmmcalibrationnashville.com, the quotations issued in response to them, and the performance of CMM Calibration and Repair and related work arranged through this site. Acceptance is by conduct — submitting a request, or accepting a quotation issued in response to one. A signed supply agreement or agreed purchase-order terms already in place take precedence over these terms, to the extent of any conflict.

Reviewing a Request
Every request is reviewed before a quotation is issued. That review confirms that the requirement is stated clearly and understood, that the method, range and measurement capability needed are available, and that the laboratory selected to carry out the work is competent to perform it.
Where a statement of conformity is required, the decision rule to be applied is agreed in writing before work begins, together with the specification the item is to be assessed against. If a requirement changes after acceptance, the review is repeated and the change is confirmed to the customer before work continues. Requests that cannot be met as specified are declined, or returned with an alternative scope — never accepted and quietly reduced.
Externally Provided Services
Technical work described on this site is externally provided. The position of the operator is stated exactly: Nashville CMM Calibration and Repair operates cmmcalibrationnashville.com as a marketing and referral website, it is not itself a calibration laboratory, and it does not perform the measurements described here. External laboratories receive the requests, and each holds its own accreditation, operates its own quality management system, and issues its own certificates and reports.
Criteria for selecting one of them are stated, not left to preference: current accreditation and the scope of it, demonstrated capability for the specific measurement requested, traceability arrangements, and record of on-time delivery. Performance is monitored on an ongoing basis and a provider that ceases to meet the criteria is not used. Any instruction from a customer that work must not be subcontracted is honored, failing which the request is declined.
In connection with that introduction the operator of this website is paid, whether as a referral fee, a fixed fee for the use of this website, or a commission on work that is placed. The commercial relationship behind the site is set out here, not left implicit. The price quoted is unaffected, and the payment gives the operator no role in performing, approving or certifying any measurement.
Quotations and Validity
Each quotation is issued in writing and stays valid for thirty (30) days from the date of issue, unless it states otherwise. What goes into it is the item description, the quantity, the measurement points, the tolerances, and the turnaround given with the request.
If the item on arrival is not the item described — extra channels, a wider range, damage, or a condition that needs repair before measurement can happen — the work pauses for a revised quotation, and resumes only once that revision is approved in writing.
Turnaround
Turnaround is stated in business days. It runs from whichever comes later: receipt of the item, or receipt of written approval to proceed. Where capacity allows, expedited handling is available and is quoted separately. Every commitment is given in good faith against current capacity, and a commitment that cannot be met is notified as soon as the delay is known, with a revised date.
Shipping, Handling and Risk
Items must be shipped in protective packaging adequate for transit, together with any accessories, fixtures, cables or software needed to complete the work. Transit risk in both directions rests with the customer unless carriage has been arranged and charged on the quotation.
Items found to be unsafe, contaminated, or outside the condition accepted at review are returned unworked, and the reason is stated. Completed items are held at the customer's risk after the collection or despatch period agreed on the quotation.
Payment Terms
Two payment positions apply. Without a credit account approved in advance, payment is due in full before certificates and items are released. With one, invoices are payable net thirty (30) days from the date of invoice.
Taxes, duties and carriage sit outside the quoted price unless the quotation states otherwise. Overdue balances may accrue interest at the lower of one and one-half percent (1.5%) per month or the maximum permitted by law, and further work may be suspended while an account is overdue.
Certificates and Their Reproduction
Certificates and reports come from the laboratory that performed the work and remain its technical record. The customer, on payment in full, holds an unrestricted right to keep, copy and use the certificate for its own quality, audit and regulatory purposes.
Because a certificate is issued as a complete document, it may be reproduced only in full; written approval is needed for partial reproduction. Copies are retained for the period stated in the performing laboratory's records policy, and reissues are made against the original certificate number.
Confidentiality
Anything obtained or created while handling a request — drawings, specifications, tolerances, measurement results, and the existence of the engagement itself — is confidential, and reaches only the personnel and providers who need it to complete the work, a body to which the law requires disclosure, or an accreditation body exercising its rights of access.
A customer is notified when a legally required disclosure is made, except where that notification is itself prohibited.
Remedies and Liability
The work is performed with reasonable skill and care and in accordance with the methods and standards stated on the quotation and on the resulting certificate. Where it is shown to be defective, re-performance of the affected work or a refund of the amount paid for it is the remedy, at the customer's election.
Total liability arising out of any engagement is limited to the amount paid for the work giving rise to the claim, to the maximum extent permitted by law. Liability does not extend to loss of profit, loss of production, loss of contract, or any indirect or consequential loss. Liability that cannot be limited by law is not limited here.
Governing Law and Revisions
The laws of Tennessee, without regard to conflict-of-law principles, govern these terms, and any claim is heard in the courts of that jurisdiction unless a different forum has been agreed in writing.
Revision of these terms is possible at any time. Whatever version is published at cmmcalibrationnashville.com on the date a quotation is issued is the version that governs that engagement.
